LICENSE AGREEMENT

This is a LICENSE AGREEMENT between LINK-Group (LICENSOR) and You (LICENSEE). Licensor grants to licensee a personal non-exclusive, non-transferable license to use the ModuLand Cytoscape plug-in (SOFTWARE) for the limited purpose of research.

This Agreement grants LICENSEE no title or right of ownership in the SOFTWARE and no property right in any copyrighted materials delivered hereunder.

RESEARCH USE ONLY: LICENSEE states that he or she will use the SOFTWARE for research purposes only, and that the SOFTWARE will not be used in products for resale and will not serve as a basis or part of any other commercial activity.

DISCLAIMER OF WARRANTY: LICENSOR provides the SOFTWARE on an "as is" basis. LICENSOR does not warrant, guarantee or make any representations regarding the use or results of the use of the SOFTWARE with respect to its correctness, accuracy, reliability or performance. The entire risk of the use and performance of the SOFTWARE is assumed by LICENSEE. All warranties including, without limitation, any warranty of fitness for a particular purpose or merchantability are hereby excluded.

LIMITATION OF LIABILITY, INDEMNIFICATION: Even if informed of the possibility of such damages, under no circumstance shall LICENSOR be liable to LICENSEE or any third party for damages of any character, including, without limitation, direct, indirect, incidental, consequential or special damages, loss of use, loss of goodwill, computer failure or malfunction. LICENSEE agrees to indemnify and hold harmless LICENSOR for any and all liability LICENSOR may incur as a result of LICENSEE using the SOFTWARE.

The LICENSEE agrees that in case of any scientific publications using the ModuLand Cytoscape plug-in will quote the original publication describing the plug-in accessible HERE .
